If you do not agree with any portion of this Policy or our Terms and Conditions of Use, you should immediately discontinue access to and use of the TX.org Services.

For purposes of applicable data-protection laws, TX acts as a data controller with respect to personal information it directly collects and for which it determines the purposes and means of processing, and as a data processor when handling personal information solely on behalf of independent regulated third-party providers in connection with compliance, tokenization, or related services.

This Policy applies only to personal information that TX collects and controls in connection with the TX.org Services. It does not apply to information collected, used, or controlled by any third-party service provider, tokenization partner, blockchain network, or other independent entity with whom you may interact through the TX.org Services. For avoidance of doubt, TX acts as a non-custodial technology platform. We do not hold, manage, or control user wallets, private keys, or funds, and we do not broker or execute transactions involving digital assets or tokens. All regulated or financial activities, if any, are performed solely by independent third-party providers who are responsible for their own data-handling and compliance practices.

If any material changes are made to the way we collect or use your personal information, TX will provide additional notice (for example, via email or prominent notice on our website) as required by law.

If you do not agree with any amendment or modification to this Policy, you must discontinue use of the TX.org Services.

4. Personal Information We Collect

TX collects limited categories of personal information necessary to operate, maintain, and secure the TX.org Services and to comply with applicable laws and regulatory requirements. We do not collect or control private key data, wallet credentials, or on-chain transactional information beyond what is technically and publicly available.

For purposes of this Policy, “personal information” means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual or household.

4.2. Platform-Level Data Sharing for User Onboarding

User accounts are created and managed at the TX platform level. To streamline onboarding and verification, certain limited user data—such as name, alias, email, and KYC verification results—may be securely transmitted to independent third-party service providers that are separately regulated or registered to perform compliance, tokenization, or related services accessible through the TX.org Services. 

Such sharing occurs strictly for the purposes of: (i) verifying user identity and eligibility under applicable laws; (ii) enabling users to engage with specific independent third-party providers without repeating KYC procedures; and (iii) fulfilling TX’s or such providers’ legal and regulatory obligations.

Each independent third-party service provider receives only the minimum information necessary for that specific purpose. They do not receive access to other providers’ user data or to TX’s broader user database, and no personal information disclosed to a third party is transmitted back to TX once shared. 

All such data transfers are governed by written agreements requiring each recipient to (a) use the information solely for lawful onboarding or compliance purposes, and (b) maintain privacy and security protections that are no less stringent than those required by applicable law.

We may receive limited personal information from third-party vendors, identity-verification companies, or regulatory-compliance providers as part of the onboarding or verification process. These entities operate independently and are responsible for their own privacy practices. Each acts as an independent controller or processor, as applicable, under relevant data-protection laws.

4.5. tx Blockchain and Public Data

The tx blockchain, maintained and operated by tx or its affiliates, records certain public data from users’ transactions on an immutable ledger. While blockchain entries are inherently anonymous, tx may, in limited circumstances, be able to associate blockchain addresses or transactions with identifiable users based on information you provide during registration or KYC verification.

tx does not record, control, or alter the substantive content of blockchain transactions, other than limited metadata required for the proper operation of the tx.org Services. Because of the transparent and decentralized nature of blockchain technology, data written to the blockchain is publicly accessible, permanent, and may not be modified or deleted once confirmed.

Accordingly, users should understand that any transaction information broadcast to the tx blockchain may become permanently public. tx takes reasonable technical and organizational measures to avoid linking personal identifiers to on-chain records, except where doing so is necessary for compliance, security, or fraud-prevention purposes.

By participating in blockchain-based activities through the tx.org Services, you acknowledge that tx does not have the ability to delete, alter, or anonymize public ledger entries once recorded, and that you are solely responsible for ensuring that personal identifiers or other sensitive information are not included in any transaction data submitted to or through the TX blockchain. Users should be aware that such on-chain information may remain permanently and publicly accessible.

4.6. Special Notice on Cookies and Tracking Technologies

TX and certain authorized third-party analytics and compliance vendors use cookies, pixel tags, local storage, and other similar technologies (collectively, “Cookies”) to operate and improve the TX.org Services, to enhance security, and to help ensure compliance with applicable laws and regulations.

  1. What Cookies Are. Cookies are small text files or data fragments placed on your browser or device when you visit a website. They enable the recognition of your browser or device, help maintain secure sessions, and collect information about your use of online services. Some Cookies are temporary (“session” cookies) and are deleted when you close your browser; others remain on your device until deleted (“persistent” cookies).
  2. How TX Uses Cookies. We use Cookies and related technologies to: 
  • Recognize returning users and remember user preferences and login sessions;
  • Authenticate users, maintain session security, and prevent unauthorized access or fraudulent activity;
  • Support and verify AML/KYC compliance procedures, including fraud detection and unusual-activity monitoring; 
  • Analysis of usage patterns and performance to improve functionality and user experience;
  • Conduct aggregated statistical analysis to understand how the TX.org Services are accessed and used.Some Cookies are strictly necessary for the operation of the TX.org Services, while others (such as analytics or customization Cookies) are used to improve performance or personalization.
  1. Third-Party Cookies. Certain third-party vendors may place Cookies on your device on TX’s behalf to perform analytics, security, or compliance services. These vendors act under TX’s instructions and are bound by confidentiality and data-protection obligations. TX does not permit these vendors to use Cookie data for their own independent purposes.
  2. Your Choices. Most web browsers automatically accept Cookies, but you can usually modify your browser settings to decline or delete Cookies. If you choose to block or delete Cookies, some features or functionality of the TX.org Services may be unavailable or may not operate as intended. 5. How we use personal information

TX.org Services, meet legal and regulatory obligations, and provide users with a secure and compliant experience. We do not sell, lease, or otherwise monetize personal information, and we do not use personal data for targeted advertising or profiling unrelated to the Services.

User Communications

To respond to inquiries, send administrative notices, and provide information related to the user’s account or the Services.

Product Development

To evaluate, research, and develop new features or improvements consistent with user expectations and applicable privacy standards; to analyze De-identified or aggregated data derived from user activity on the Website for purposes of improving, developing, and enhancing its products and services, provided that such data does not identify any individual user or disclose any confidential information.

Consent-Based Users

For any other purpose for which you have expressly provided consent, which may be withdrawn at any time.

TX limits access to personal information to authorized personnel who require it to perform their duties and who are bound by confidentiality and data-protection obligations. When TX uses service providers to process data on its behalf, those providers act solely under TX’s instructions and are prohibited from using the information for any independent purpose.

Regulated Third-Party Providers Accessed Through the Platform

When users choose to engage with or be introduced to independent regulated providers (for example, tokenization or blockchain-service providers), tx may transmit limited user data necessary to facilitate onboarding or compliance.

Each provider receives only the minimum data necessary for that interaction and remains solely responsible for its own data handling and privacy practices. tx does not monitor or control these providers once data is transferred.

Corporate or Structural Transactions

In connection with any actual or proposed reorganization, merger, acquisition, sale of assets, or similar corporate transaction involving tx Labs, where such information is necessary to evaluate or complete the transaction.

Any recipient will be bound by confidentiality and data-protection obligations consistent with this Policy.

Legal and Regulatory Authorities

When required to comply with applicable laws, regulations, subpoenas, court orders, or requests from law enforcement, regulatory, or government agencies. tx may also disclose information where it believes, in good faith, that disclosure is necessary to protect its rights or the safety of users or others.

Disclosures are made only to the extent legally required or expressly permitted by law.

Professional Advisors

To auditors, legal counsel, accountants, and other professional advisors engaged by TX in the ordinary course of business.

These parties are subject to confidentiality and professional obligations.

Aggregated or De-Identified Data

tx may share aggregated or de-identified data that cannot reasonably be used to identify an individual, for research, analytics, or industry benchmarking purposes.

Such data does not contain personal identifiers and is not subject to this Policy.

tx may also share personal information with its affiliates or subsidiaries for purposes consistent with this Policy, including service delivery, compliance, security, and platform operations, provided that such entities are bound by equivalent privacy and security obligations.

tx requires any recipient of personal information to maintain comparable privacy and security standards and to use the information only for the purpose for which it was disclosed. tx does not disclose personal information to third parties for their own independent marketing, profiling, or advertising purposes. Once information is shared with an independent regulated provider at a user’s request, that provider’s use of the data is governed by its own privacy policy and regulatory obligations

7. Information security

tx takes the protection of personal information seriously and implements physical, administrative, and technical safeguards designed to preserve the confidentiality, integrity, and availability of information processed through the tx.org Services.

We employ a layered security framework that includes:

  • Encryption and Secure Transmission: Sensitive information transmitted through the tx.org Services is protected using SSL/TLS encryption and other industry-standard security protocols.
  • Access Controls: Access to personal information is restricted to authorized personnel who require it to perform their duties and who are bound by confidentiality and data-protection obligations.
  • Data Segregation and Storage: KYC and related compliance data are stored in encrypted form within secure systems operated by tx or its designated independent service providers.
  • Monitoring and Testing: tx periodically reviews its security measures and conducts internal assessments to identify vulnerabilities and improve controls.
  • Vendor Oversight: Independent service providers handling personal information on tx’s behalf are required by contract to implement and maintain appropriate technical and organizational safeguards.
  • Data Breach Notification: In the event of a data breach that compromises the security of personal information, tx will promptly investigate the incident and notify affected users and relevant supervisory authorities in accordance with applicable data protection laws and within the timelines required under the GDPR and other relevant regulations.

tx does not and cannot control the security practices of independent third-party providers that users may choose to engage through the tx.org Services. Once personal information is transferred to such a provider, the provider’s own policies and security standards apply.

Despite our efforts, no security system is impenetrable, and no method of data transmission or storage can be guaranteed 100% secure. Accordingly, while tx strives to protect personal information, we cannot warrant the absolute security of any data transmitted to or through the TX.org Services.

You are responsible for maintaining the confidentiality of your tx account credentials and for promptly notifying tx of any suspected unauthorized access or security breach involving your account. tx will take reasonable steps to mitigate and investigate any suspected or actual breach consistent with applicable laws and its incident-response procedures.

8. Retention of personal information

tx retains personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal and regulatory obligations, to resolve disputes, and to enforce our agreements.

We apply the following general principles to retention: 

  • Operational and Contractual Necessity: Personal information is retained for as long as your tx account remains active or as needed to provide the tx.org Services. Once your account is closed or inactive, tx will retain limited information only as required to comply with legal or contractual obligations.
  • Legal and Regulatory Requirements: Certain laws and regulations, including anti-money-laundering (AML) and financial recordkeeping rules, require tx to maintain specific records for prescribed periods. As a result, KYC documentation, transaction records, and related compliance data may be retained for seven (7) to ten (10) years following the user’s last activity, depending on the jurisdiction.
  • Dispute Resolution and Enforcement: tx may retain relevant information as necessary to protect its legal interests, defend against claims, or comply with audit, tax, or regulatory inquiries.
  • Data Minimization and Secure Disposal: When personal information is no longer needed for the purposes above, tx will securely delete, anonymize, or aggregate it in a manner consistent with applicable data-protection and record-retention laws.

When tx acts as a service provider to independent regulated entities, those entities may have their own legal obligations governing how long they must retain data. Once personal information has been transferred to such third parties, their retention and deletion practices are governed by their respective privacy policies and regulatory frameworks.

9. Rights regarding your Personal Information

Depending on where you reside, you may have certain rights under applicable privacy and data-protection laws. tx is committed to honoring these rights in a manner consistent with our legal obligations and operational responsibilities.

9.1. Access, Correction, Deletion, and Portability

You may request that tx: 

  • Access the personal information we hold about you and provide a copy of it;
  • Correct inaccurate or incomplete information;
  • Delete information, subject to legal or regulatory retention requirements; and
  • Provide your information in a portable, machine-readable format where technically feasible.

We will respond to such requests in accordance with applicable law and may require verification of your identity before processing any request.

9.2. Right to Restrict or Object

Where provided by law, you may have the right to: 

  • Restrict or object to certain processing of your personal information, including where we rely on legitimate interests; or
  • Withdraw Consent at any time when processing is based on your consent.

Withdrawal of consent will not affect the lawfulness of processing that occurred prior to withdrawal or of processing that is required by law.

9.3. Right to Opt Out of “Sale” or “Sharing”

tx does not sell or “share” personal information for cross-context behavioural advertising or marketing purposes as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA). If tx’s practices were ever to change, we would update this Policy and provide the legally required mechanisms to exercise opt-out rights.

9.4. Right to Non-Discrimination

tx will not discriminate against you for exercising any privacy rights. This includes denying services, charging different prices, or providing a different level or quality of service, except to the extent permitted by law.

9.5. Exceptions and Limitations

Certain information may be exempt from these rights, for example where retention or processing is required for:

  • Compliance with AML/KYC, tax, audit, or other legal obligations;
  • Detection and prevention of fraud or security incidents;
  • Exercising or defending legal claims; or
  • Performing a contract you have requested. 

Where such exceptions apply, tx will explain the basis for denial of a request to the extent legally permissible.

9.6. How to Exercise Your Rights

You may submit a privacy-rights request by contacting tx through the mechanism described on the “contact us” section on the tx.org website. Please include sufficient information to verify your identity and the nature of your request. tx may decline to fulfill requests that are unfounded, excessive, or not permitted by law.

We will acknowledge and respond to requests within the time periods required by applicable law. If you are dissatisfied with our response, you may have the right to contact or lodge a complaint with your local data-protection authority or supervisory agency.

10. Direct Marketing

Subject to applicable laws and regulations, tx may, from time to time, send you marketing or informational materials about our products, services, features, or events that we believe may be relevant to you. These communications may include email messages, in-application notifications, or other permitted electronic formats. tx limits such outreach to information related to the tx.org Services or to updates that we reasonably believe will improve your experience with our platform.

10.1. Lawful Basis for Marketing

Where required by law, tx will obtain your consent before sending marketing communications. In jurisdictions that permit communications based on an existing business relationship, tx relies on its legitimate interest in keeping users informed about platform developments and compliance updates. You may withdraw your consent or object to marketing at any time as described below.

10.2. Your Choices and Opt-Out Options

If you prefer not to receive marketing-related communications, you may opt out at any time by:

  • Clicking the “unsubscribe” link included at the bottom of each such marketing email; or

Once we receive your request, tx will promptly update your preferences. Please note that it may take a short period to process your request, and you may still receive transactional or service-related communications—such as account notices, security alerts, or legal updates—that are not promotional in nature.

10.3. No Third-Party Marketing

tx does not provide or disclose personal information to any independent third party for their own advertising, promotional, or cross-context behavioral-marketing purposes. All communications originate directly from tx or from service providers acting strictly on our behalf and under our instruction.

11. Data Transfer

Because tx Labs operates in a distributed technology and compliance environment, your personal information may be stored, processed, or accessed in countries or territories other than your own. These locations may include jurisdictions where tx Labs, its affiliates, or its authorized service providers maintain facilities or technical infrastructure.

11.1. Cross-Border Processing

Personal information collected through the tx.org Services may be transferred to, and maintained on, servers located in the United States or other jurisdictions where data-protection standards may differ from those in your country of residence. By using the tx.org Services, you acknowledge that your information may be transferred to such jurisdictions for the purposes described in this Policy.

11.2. Safeguards for International Transfers

tx Labs takes steps to ensure that all cross-border data transfers are performed in accordance with applicable privacy and data-protection laws. These safeguards may include:

  • Executing data-processing agreements with service providers that incorporate standard contractual clauses or equivalent transfer mechanisms approved under relevant data-protection laws;

When tx Labs relies on approved contractual clauses or comparable safeguards, copies or summaries of those safeguards may be made available upon written request, subject to confidentiality restrictions.

Independent third-party service providers that process personal information on tx’s behalf—such as hosting, analytics, or compliance vendors—may store or access data in multiple jurisdictions. These providers are required by contract to process personal information solely under tx’s instruction and to implement appropriate security and confidentiality measures.

The tx.org Services may include links, integrations, or interfaces to independent third-party websites, applications, blockchain networks, or other online resources (collectively, “Third-Party Services”). These are provided solely for convenience and informational purposes.

tx does not own, operate, or control any Third-Party Services, and we make no representations or warranties regarding their security, data-handling practices, or content. When you access or interact with a Third-Party Service — including when you connect a third-party wallet or use a third-party tokenization or compliance tool — you do so at your own discretion and subject to that third party’s own terms and privacy policy.

We encourage you to review the privacy and data-protection policies of every Third-Party Service you use or link to through the tx.org Services before submitting any personal information.

tx is not responsible or liable for any information, products, or services offered by Third-Party Services, nor for any losses, damages, or disputes that may arise from your interactions with them. Any data you provide directly to a Third-Party Service will be governed by that provider’s privacy practices, not this Policy.

13. Children’s Privacy

The tx.org Services are not directed to, and may not be used by, individuals under the age of eighteen (18). tx does not knowingly collect, maintain, or process personal information from any person under 18 years of age.

By accessing or using the tx.org Services, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, if higher). If you are under 18 years of age, you must not visit, access, or use the tx.org Services at any time or in any manner.

If tx becomes aware that personal information has been collected from an individual under the age of 18, tx will take appropriate steps to delete such information and, where feasible, terminate the associated account or access credentials. 

Because tx does not knowingly solicit or process information from minors, any use of the Services by a person under 18 constitutes an unauthorized use in violation of our Terms of Use. Parents or legal guardians who believe that a minor has provided personal information to tx may contact us as directed under the “contact us” section of the website to request deletion or further information.

We do not hold, manage, or control user wallets, private keys, or funds, and we do not broker or execute transactions involving digital assets or tokens. All regulated or financial activities, if any, are performed solely by independent third-party providers who are responsible for their own data-handling and compliance practices.

TX collects limited categories of personal information necessary to operate, maintain, and secure the TX.org Services and to comply with applicable laws and regulatory requirements. We do not collect or control private key data, wallet credentials, or on-chain transactional information beyond what is technically and publicly available.

For purposes of this Policy, “personal information” means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual or household.

4.2. Platform-Level Data Sharing for User Onboarding

User accounts are created and managed at the TX platform level. To streamline onboarding and verification, certain limited user data—such as name, alias, email, and KYC verification results—may be securely transmitted to independent third-party service providers that are separately regulated or registered to perform compliance, tokenization, or related services accessible through the TX.org Services. 

Such sharing occurs strictly for the purposes of: (i) verifying user identity and eligibility under applicable laws; (ii) enabling users to engage with specific independent third-party providers without repeating KYC procedures; and (iii) fulfilling TX’s or such providers’ legal and regulatory obligations.

Each independent third-party service provider receives only the minimum information necessary for that specific purpose. They do not receive access to other providers’ user data or to TX’s broader user database, and no personal information disclosed to a third party is transmitted back to TX once shared. 

All such data transfers are governed by written agreements requiring each recipient to (a) use the information solely for lawful onboarding or compliance purposes, and (b) maintain privacy and security protections that are no less stringent than those required by applicable law.

4.5. tx Blockchain and Public Data

The tx blockchain, maintained and operated by tx or its affiliates, records certain public data from users’ transactions on an immutable ledger. While blockchain entries are inherently anonymous, tx may, in limited circumstances, be able to associate blockchain addresses or transactions with identifiable users based on information you provide during registration or KYC verification.

tx does not record, control, or alter the substantive content of blockchain transactions, other than limited metadata required for the proper operation of the tx.org Services. Because of the transparent and decentralized nature of blockchain technology, data written to the blockchain is publicly accessible, permanent, and may not be modified or deleted once confirmed.

Accordingly, users should understand that any transaction information broadcast to the tx blockchain may become permanently public. tx takes reasonable technical and organizational measures to avoid linking personal identifiers to on-chain records, except where doing so is necessary for compliance, security, or fraud-prevention purposes.

By participating in blockchain-based activities through the tx.org Services, you acknowledge that tx does not have the ability to delete, alter, or anonymize public ledger entries once recorded, and that you are solely responsible for ensuring that personal identifiers or other sensitive information are not included in any transaction data submitted to or through the TX blockchain. Users should be aware that such on-chain information may remain permanently and publicly accessible.

4.6. Special Notice on Cookies and Tracking Technologies

TX and certain authorized third-party analytics and compliance vendors use cookies, pixel tags, local storage, and other similar technologies (collectively, “Cookies”) to operate and improve the TX.org Services, to enhance security, and to help ensure compliance with applicable laws and regulations.

  1. What Cookies Are. Cookies are small text files or data fragments placed on your browser or device when you visit a website. They enable the recognition of your browser or device, help maintain secure sessions, and collect information about your use of online services. Some Cookies are temporary (“session” cookies) and are deleted when you close your browser; others remain on your device until deleted (“persistent” cookies).
  2. How TX Uses Cookies. We use Cookies and related technologies to: 
  • Recognize returning users and remember user preferences and login sessions;
  • Authenticate users, maintain session security, and prevent unauthorized access or fraudulent activity;
  • Support and verify AML/KYC compliance procedures, including fraud detection and unusual-activity monitoring;

  1. Third-Party Cookies. Certain third-party vendors may place Cookies on your device on TX’s behalf to perform analytics, security, or compliance services. These vendors act under TX’s instructions and are bound by confidentiality and data-protection obligations. TX does not permit these vendors to use Cookie data for their own independent purposes.

TX.org Services, meet legal and regulatory obligations, and provide users with a secure and compliant experience. We do not sell, lease, or otherwise monetize personal information, and we do not use personal data for targeted advertising or profiling unrelated to the Services.

TX limits access to personal information to authorized personnel who require it to perform their duties and who are bound by confidentiality and data-protection obligations. When TX uses service providers to process data on its behalf, those providers act solely under TX’s instructions and are prohibited from using the information for any independent purpose.

Each provider receives only the minimum data necessary for that interaction and remains solely responsible for its own data handling and privacy practices. tx does not monitor or control these providers once data is transferred.

Corporate or Structural Transactions

In connection with any actual or proposed reorganization, merger, acquisition, sale of assets, or similar corporate transaction involving tx Labs, where such information is necessary to evaluate or complete the transaction.

Any recipient will be bound by confidentiality and data-protection obligations consistent with this Policy.

Legal and Regulatory Authorities

When required to comply with applicable laws, regulations, subpoenas, court orders, or requests from law enforcement, regulatory, or government agencies. tx may also disclose information where it believes, in good faith, that disclosure is necessary to protect its rights or the safety of users or others.

Disclosures are made only to the extent legally required or expressly permitted by law.

Professional Advisors

To auditors, legal counsel, accountants, and other professional advisors engaged by TX in the ordinary course of business.

These parties are subject to confidentiality and professional obligations.

Aggregated or De-Identified Data

tx may share aggregated or de-identified data that cannot reasonably be used to identify an individual, for research, analytics, or industry benchmarking purposes.

Such data does not contain personal identifiers and is not subject to this Policy.

tx may also share personal information with its affiliates or subsidiaries for purposes consistent with this Policy, including service delivery, compliance, security, and platform operations, provided that such entities are bound by equivalent privacy and security obligations.

tx requires any recipient of personal information to maintain comparable privacy and security standards and to use the information only for the purpose for which it was disclosed. tx does not disclose personal information to third parties for their own independent marketing, profiling, or advertising purposes. Once information is shared with an independent regulated provider at a user’s request, that provider’s use of the data is governed by its own privacy policy and regulatory obligations

7. Information security

tx takes the protection of personal information seriously and implements physical, administrative, and technical safeguards designed to preserve the confidentiality, integrity, and availability of information processed through the tx.org Services.

We employ a layered security framework that includes:

  • Encryption and Secure Transmission: Sensitive information transmitted through the tx.org Services is protected using SSL/TLS encryption and other industry-standard security protocols.
  • Access Controls: Access to personal information is restricted to authorized personnel who require it to perform their duties and who are bound by confidentiality and data-protection obligations.
  • Data Segregation and Storage: KYC and related compliance data are stored in encrypted form within secure systems operated by tx or its designated independent service providers.
  • Monitoring and Testing: tx periodically reviews its security measures and conducts internal assessments to identify vulnerabilities and improve controls.
  • Vendor Oversight: Independent service providers handling personal information on tx’s behalf are required by contract to implement and maintain appropriate technical and organizational safeguards.
  • Data Breach Notification: In the event of a data breach that compromises the security of personal information, tx will promptly investigate the incident and notify affected users and relevant supervisory authorities in accordance with applicable data protection laws and within the timelines required under the GDPR and other relevant regulations.

tx does not and cannot control the security practices of independent third-party providers that users may choose to engage through the tx.org Services. Once personal information is transferred to such a provider, the provider’s own policies and security standards apply.

Despite our efforts, no security system is impenetrable, and no method of data transmission or storage can be guaranteed 100% secure. Accordingly, while tx strives to protect personal information, we cannot warrant the absolute security of any data transmitted to or through the TX.org Services.

You are responsible for maintaining the confidentiality of your tx account credentials and for promptly notifying tx of any suspected unauthorized access or security breach involving your account. tx will take reasonable steps to mitigate and investigate any suspected or actual breach consistent with applicable laws and its incident-response procedures.

8. Retention of personal information

tx retains personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal and regulatory obligations, to resolve disputes, and to enforce our agreements.

We apply the following general principles to retention: 

  • Operational and Contractual Necessity: Personal information is retained for as long as your tx account remains active or as needed to provide the tx.org Services. Once your account is closed or inactive, tx will retain limited information only as required to comply with legal or contractual obligations.
  • Legal and Regulatory Requirements: Certain laws and regulations, including anti-money-laundering (AML) and financial recordkeeping rules, require tx to maintain specific records for prescribed periods. As a result, KYC documentation, transaction records, and related compliance data may be retained for seven (7) to ten (10) years following the user’s last activity, depending on the jurisdiction.
  • Dispute Resolution and Enforcement: tx may retain relevant information as necessary to protect its legal interests, defend against claims, or comply with audit, tax, or regulatory inquiries.
  • Data Minimization and Secure Disposal: When personal information is no longer needed for the purposes above, tx will securely delete, anonymize, or aggregate it in a manner consistent with applicable data-protection and record-retention laws.

When tx acts as a service provider to independent regulated entities, those entities may have their own legal obligations governing how long they must retain data. Once personal information has been transferred to such third parties, their retention and deletion practices are governed by their respective privacy policies and regulatory frameworks.

9. Rights regarding your Personal Information

Depending on where you reside, you may have certain rights under applicable privacy and data-protection laws. tx is committed to honoring these rights in a manner consistent with our legal obligations and operational responsibilities.

9.1. Access, Correction, Deletion, and Portability

You may request that tx: 

  • Access the personal information we hold about you and provide a copy of it;
  • Correct inaccurate or incomplete information;
  • Delete information, subject to legal or regulatory retention requirements; and
  • Provide your information in a portable, machine-readable format where technically feasible.

We will respond to such requests in accordance with applicable law and may require verification of your identity before processing any request.

9.2. Right to Restrict or Object

Where provided by law, you may have the right to: 

  • Restrict or object to certain processing of your personal information, including where we rely on legitimate interests; or
  • Withdraw Consent at any time when processing is based on your consent.

Withdrawal of consent will not affect the lawfulness of processing that occurred prior to withdrawal or of processing that is required by law.

9.3. Right to Opt Out of “Sale” or “Sharing”

tx does not sell or “share” personal information for cross-context behavioural advertising or marketing purposes as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA). If tx’s practices were ever to change, we would update this Policy and provide the legally required mechanisms to exercise opt-out rights.

9.4. Right to Non-Discrimination

tx will not discriminate against you for exercising any privacy rights. This includes denying services, charging different prices, or providing a different level or quality of service, except to the extent permitted by law.

9.5. Exceptions and Limitations

Certain information may be exempt from these rights, for example where retention or processing is required for:

  • Compliance with AML/KYC, tax, audit, or other legal obligations;
  • Detection and prevention of fraud or security incidents;
  • Exercising or defending legal claims; or
  • Performing a contract you have requested. 

Where such exceptions apply, tx will explain the basis for denial of a request to the extent legally permissible.

9.6. How to Exercise Your Rights

You may submit a privacy-rights request by contacting tx through the mechanism described on the “contact us” section on the tx.org website. Please include sufficient information to verify your identity and the nature of your request. tx may decline to fulfill requests that are unfounded, excessive, or not permitted by law.

We will acknowledge and respond to requests within the time periods required by applicable law. If you are dissatisfied with our response, you may have the right to contact or lodge a complaint with your local data-protection authority or supervisory agency.

10. Direct Marketing

Subject to applicable laws and regulations, tx may, from time to time, send you marketing or informational materials about our products, services, features, or events that we believe may be relevant to you. In jurisdictions that permit communications based on an existing business relationship, tx relies on its legitimate interest in keeping users informed about platform developments and compliance updates. If you prefer not to receive marketing-related communications, you may opt out at any time by:

  • Clicking the “unsubscribe” link included at the bottom of each such marketing email; or

10.3. No Third-Party Marketing

tx does not provide or disclose personal information to any independent third party for their own advertising, promotional, or cross-context behavioral-marketing purposes. All communications originate directly from tx or from service providers acting strictly on our behalf and under our instruction.

11.1. Cross-Border Processing

Personal information collected through the tx.org Services may be transferred to, and maintained on, servers located in the United States or other jurisdictions where data-protection standards may differ from those in your country of residence. By using the tx.org Services, you acknowledge that your information may be transferred to such jurisdictions for the purposes described in this Policy.

tx Labs takes steps to ensure that all cross-border data transfers are performed in accordance with applicable privacy and data-protection laws. These safeguards may include:

tx does not own, operate, or control any Third-Party Services, and we make no representations or warranties regarding their security, data-handling practices, or content. When you access or interact with a Third-Party Service — including when you connect a third-party wallet or use a third-party tokenization or compliance tool — you do so at your own discretion and subject to that third party’s own terms and privacy policy.

We encourage you to review the privacy and data-protection policies of every Third-Party Service you use or link to through the tx.org Services before submitting any personal information.

tx is not responsible or liable for any information, products, or services offered by Third-Party Services, nor for any losses, damages, or disputes that may arise from your interactions with them. Any data you provide directly to a Third-Party Service will be governed by that provider’s privacy practices, not this Policy.

13. Children’s Privacy

The tx.org Services are not directed to, and may not be used by, individuals under the age of eighteen (18). tx does not knowingly collect, maintain, or process personal information from any person under 18 years of age.

By accessing or using the tx.org Services, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, if higher). If you are under 18 years of age, you must not visit, access, or use the tx.org Services at any time or in any manner.

If tx becomes aware that personal information has been collected from an individual under the age of 18, tx will take appropriate steps to delete such information and, where feasible, terminate the associated account or access credentials. 

Because tx does not knowingly solicit or process information from minors, any use of the Services by a person under 18 constitutes an unauthorized use in violation of our Terms of Use. TX collects limited categories of personal information necessary to operate, maintain, and secure the TX.org Services and to comply with applicable laws and regulatory requirements. We do not collect or control private key data, wallet credentials, or on-chain transactional information beyond what is technically and publicly available.

For purposes of this Policy, “personal information” means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual or household.

4.2. Platform-Level Data Sharing for User Onboarding

User accounts are created and managed at the TX platform level. To streamline onboarding and verification, certain limited user data—such as name, alias, email, and KYC verification results—may be securely transmitted to independent third-party service providers that are separately regulated or registered to perform compliance, tokenization, or related services accessible through the TX.org Services. 

Such sharing occurs strictly for the purposes of: (i) verifying user identity and eligibility under applicable laws; (ii) enabling users to engage with specific independent third-party providers without repeating KYC procedures; and (iii) fulfilling TX’s or such providers’ legal and regulatory obligations.

Each independent third-party service provider receives only the minimum information necessary for that specific purpose. They do not receive access to other providers’ user data or to TX’s broader user database, and no personal information disclosed to a third party is transmitted back to TX once shared. 

All such data transfers are governed by written agreements requiring each recipient to (a) use the information solely for lawful onboarding or compliance purposes, and (b) maintain privacy and security protections that are no less stringent than those required by applicable law.

4.5. tx Blockchain and Public Data

The tx blockchain, maintained and operated by tx or its affiliates, records certain public data from users’ transactions on an immutable ledger. While blockchain entries are inherently anonymous, tx may, in limited circumstances, be able to associate blockchain addresses or transactions with identifiable users based on information you provide during registration or KYC verification.

tx does not record, control, or alter the substantive content of blockchain transactions, other than limited metadata required for the proper operation of the tx.org Services. Because of the transparent and decentralized nature of blockchain technology, data written to the blockchain is publicly accessible, permanent, and may not be modified or deleted once confirmed.

Accordingly, users should understand that any transaction information broadcast to the tx blockchain may become permanently public. tx takes reasonable technical and organizational measures to avoid linking personal identifiers to on-chain records, except where doing so is necessary for compliance, security, or fraud-prevention purposes.

By participating in blockchain-based activities through the tx.org Services, you acknowledge that tx does not have the ability to delete, alter, or anonymize public ledger entries once recorded, and that you are solely responsible for ensuring that personal identifiers or other sensitive information are not included in any transaction data submitted to or through the TX blockchain. Users should be aware that such on-chain information may remain permanently and publicly accessible.

4.6. Special Notice on Cookies and Tracking Technologies

TX and certain authorized third-party analytics and compliance vendors use cookies, pixel tags, local storage, and other similar technologies (collectively, “Cookies”) to operate and improve the TX.org Services, to enhance security, and to help ensure compliance with applicable laws and regulations.

  1. What Cookies Are. Cookies are small text files or data fragments placed on your browser or device when you visit a website. They enable the recognition of your browser or device, help maintain secure sessions, and collect information about your use of online services. Some Cookies are temporary (“session” cookies) and are deleted when you close your browser; others remain on your device until deleted (“persistent” cookies).
  2. How TX Uses Cookies. We use Cookies and related technologies to: 
  • Recognize returning users and remember user preferences and login sessions;

TX limits access to personal information to authorized personnel who require it to perform their duties and who are bound by confidentiality and data-protection obligations. When TX uses service providers to process data on its behalf, those providers act solely under TX’s instructions and are prohibited from using the information for any independent purpose.

Each provider receives only the minimum data necessary for that interaction and remains solely responsible for its own data handling and privacy practices. tx does not monitor or control these providers once data is transferred.

Corporate or Structural Transactions

In connection with any actual or proposed reorganization, merger, acquisition, sale of assets, or similar corporate transaction involving tx Labs, where such information is necessary to evaluate or complete the transaction.

Any recipient will be bound by confidentiality and data-protection obligations consistent with this Policy.

Legal and Regulatory Authorities

When required to comply with applicable laws, regulations, subpoenas, court orders, or requests from law enforcement, regulatory, or government agencies. tx may also disclose information where it believes, in good faith, that disclosure is necessary to protect its rights or the safety of users or others.

Disclosures are made only to the extent legally required or expressly permitted by law.

Professional Advisors

To auditors, legal counsel, accountants, and other professional advisors engaged by TX in the ordinary course of business.

These parties are subject to confidentiality and professional obligations.

Aggregated or De-Identified Data

tx may share aggregated or de-identified data that cannot reasonably be used to identify an individual, for research, analytics, or industry benchmarking purposes.

Such data does not contain personal identifiers and is not subject to this Policy.

tx may also share personal information with its affiliates or subsidiaries for purposes consistent with this Policy, including service delivery, compliance, security, and platform operations, provided that such entities are bound by equivalent privacy and security obligations.

tx requires any recipient of personal information to maintain comparable privacy and security standards and to use the information only for the purpose for which it was disclosed. tx does not disclose personal information to third parties for their own independent marketing, profiling, or advertising purposes. Once information is shared with an independent regulated provider at a user’s request, that provider’s use of the data is governed by its own privacy policy and regulatory obligations

7. Information security

tx takes the protection of personal information seriously and implements physical, administrative, and technical safeguards designed to preserve the confidentiality, integrity, and availability of information processed through the tx.org Services.

We employ a layered security framework that includes:

  • Encryption and Secure Transmission: Sensitive information transmitted through the tx.org Services is protected using SSL/TLS encryption and other industry-standard security protocols.
  • Access Controls: Access to personal information is restricted to authorized personnel who require it to perform their duties and who are bound by confidentiality and data-protection obligations.
  • Data Segregation and Storage: KYC and related compliance data are stored in encrypted form within secure systems operated by tx or its designated independent service providers.
  • Monitoring and Testing: tx periodically reviews its security measures and conducts internal assessments to identify vulnerabilities and improve controls.
  • Vendor Oversight: Independent service providers handling personal information on tx’s behalf are required by contract to implement and maintain appropriate technical and organizational safeguards.
  • Data Breach Notification: In the event of a data breach that compromises the security of personal information, tx will promptly investigate the incident and notify affected users and relevant supervisory authorities in accordance with applicable data protection laws and within the timelines required under the GDPR and other relevant regulations.

tx does not and cannot control the security practices of independent third-party providers that users may choose to engage through the tx.org Services. Once personal information is transferred to such a provider, the provider’s own policies and security standards apply.

Despite our efforts, no security system is impenetrable, and no method of data transmission or storage can be guaranteed 100% secure. Accordingly, while tx strives to protect personal information, we cannot warrant the absolute security of any data transmitted to or through the TX.org Services.

You are responsible for maintaining the confidentiality of your tx account credentials and for promptly notifying tx of any suspected unauthorized access or security breach involving your account. tx will take reasonable steps to mitigate and investigate any suspected or actual breach consistent with applicable laws and its incident-response procedures.

8. Retention of personal information

tx retains personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal and regulatory obligations, to resolve disputes, and to enforce our agreements.

We apply the following general principles to retention: 

  • Operational and Contractual Necessity: Personal information is retained for as long as your tx account remains active or as needed to provide the tx.org Services. Once your account is closed or inactive, tx will retain limited information only as required to comply with legal or contractual obligations.
  • Legal and Regulatory Requirements: Certain laws and regulations, including anti-money-laundering (AML) and financial recordkeeping rules, require tx to maintain specific records for prescribed periods. As a result, KYC documentation, transaction records, and related compliance data may be retained for seven (7) to ten (10) years following the user’s last activity, depending on the jurisdiction.
  • Dispute Resolution and Enforcement: tx may retain relevant information as necessary to protect its legal interests, defend against claims, or comply with audit, tax, or regulatory inquiries.
  • Data Minimization and Secure Disposal: When personal information is no longer needed for the purposes above, tx will securely delete, anonymize, or aggregate it in a manner consistent with applicable data-protection and record-retention laws.

When tx acts as a service provider to independent regulated entities, those entities may have their own legal obligations governing how long they must retain data. Once personal information has been transferred to such third parties, their retention and deletion practices are governed by their respective privacy policies and regulatory frameworks.

9. Rights regarding your Personal Information

Depending on where you reside, you may have certain rights under applicable privacy and data-protection laws. tx is committed to honoring these rights in a manner consistent with our legal obligations and operational responsibilities.

9.1. Access, Correction, Deletion, and Portability

You may request that tx: 

  • Access the personal information we hold about you and provide a copy of it;
  • Correct inaccurate or incomplete information;
  • Delete information, subject to legal or regulatory retention requirements; and
  • Provide your information in a portable, machine-readable format where technically feasible.

We will respond to such requests in accordance with applicable law and may require verification of your identity before processing any request.

9.2. Right to Restrict or Object

Where provided by law, you may have the right to: 

  • Restrict or object to certain processing of your personal information, including where we rely on legitimate interests; or
  • Withdraw Consent at any time when processing is based on your consent.

Withdrawal of consent will not affect the lawfulness of processing that occurred prior to withdrawal or of processing that is required by law.

9.3. Right to Opt Out of “Sale” or “Sharing”

tx does not sell or “share” personal information for cross-context behavioural advertising or marketing purposes as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA). If tx’s practices were ever to change, we would update this Policy and provide the legally required mechanisms to exercise opt-out rights.

9.4. Right to Non-Discrimination

tx will not discriminate against you for exercising any privacy rights. This includes denying services, charging different prices, or providing a different level or quality of service, except to the extent permitted by law.

9.5. Exceptions and Limitations

Certain information may be exempt from these rights, for example where retention or processing is required for:

  • Compliance with AML/KYC, tax, audit, or other legal obligations;
  • Detection and prevention of fraud or security incidents;
  • Exercising or defending legal claims; or
  • Performing a contract you have requested. 

Where such exceptions apply, tx will explain the basis for denial of a request to the extent legally permissible.

9.6. How to Exercise Your Rights

You may submit a privacy-rights request by contacting tx through the mechanism described on the “contact us” section on the tx.org website. Please include sufficient information to verify your identity and the nature of your request. tx may decline to fulfill requests that are unfounded, excessive, or not permitted by law.

We will acknowledge and respond to requests within the time periods required by applicable law. If you are dissatisfied with our response, you may have the right to contact or lodge a complaint with your local data-protection authority or supervisory agency.

10. Direct Marketing

Subject to applicable laws and regulations, tx may, from time to time, send you marketing or informational materials about our products, services, features, or events that we believe may be relevant to you. These communications may include email messages, in-application notifications, or other permitted electronic formats. tx limits such outreach to information related to the tx.org Services or to updates that we reasonably believe will improve your experience with our platform.

10.1. Lawful Basis for Marketing

Where required by law, tx will obtain your consent before sending marketing communications. In jurisdictions that permit communications based on an existing business relationship, tx relies on its legitimate interest in keeping users informed about platform developments and compliance updates. You may withdraw your consent or object to marketing at any time as described below.

10.2. Your Choices and Opt-Out Options

If you prefer not to receive marketing-related communications, you may opt out at any time by:

  • Clicking the “unsubscribe” link included at the bottom of each such marketing email; or

All communications originate directly from tx or from service providers acting strictly on our behalf and under our instruction.

11.1. Cross-Border Processing

Personal information collected through the tx.org Services may be transferred to, and maintained on, servers located in the United States or other jurisdictions where data-protection standards may differ from those in your country of residence. By using the tx.org Services, you acknowledge that your information may be transferred to such jurisdictions for the purposes described in this Policy.

11.2. Safeguards for International Transfers

tx Labs takes steps to ensure that all cross-border data transfers are performed in accordance with applicable privacy and data-protection laws. These safeguards may include:

  • Executing data-processing agreements with service providers that incorporate standard contractual clauses or equivalent transfer mechanisms approved under relevant data-protection laws;

tx does not own, operate, or control any Third-Party Services, and we make no representations or warranties regarding their security, data-handling practices, or content. When you access or interact with a Third-Party Service — including when you connect a third-party wallet or use a third-party tokenization or compliance tool — you do so at your own discretion and subject to that third party’s own terms and privacy policy.

We encourage you to review the privacy and data-protection policies of every Third-Party Service you use or link to through the tx.org Services before submitting any personal information.

tx is not responsible or liable for any information, products, or services offered by Third-Party Services, nor for any losses, damages, or disputes that may arise from your interactions with them. Any data you provide directly to a Third-Party Service will be governed by that provider’s privacy practices, not this Policy.

13. Children’s Privacy

The tx.org Services are not directed to, and may not be used by, individuals under the age of eighteen (18). tx does not knowingly collect, maintain, or process personal information from any person under 18 years of age.

By accessing or using the tx.org Services, you represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, if higher). If you are under 18 years of age, you must not visit, access, or use the tx.org Services at any time or in any manner.
